Please watch out for the 2008 Year-end Report to the People of Bulan by Mayor Helen C. De Castro.We shall post the Annual Report thru this site before the end of December.

The report shall cover all the accomplishments of the De Castro Administration for the year 2008.

    To LGU Bulan-PIO

    Thank you for your posting. Yes, we are waiting for the mayor’s 2008 Year-end report to give us the overview of her and her team’s achievements for this year and hopefully also to shed some lights to the unpleasant news circulating again. It is important for the constituents of Bulan to be sufficiently and rightly informed on what’s going on. Lack of information create an atmosphere of insecurity and darkens the town, a situation that is in contrast to our common goal of making Bulan brighter. Your team should be generous and also be prompt with handing out substantial informations to the public. In this way you can prevent the breeding of unpleasant thoughts among the people you are serving. This is the situation that destructive critics are waiting for to launch their attack because the people’s minds are vulnerable, i.e., easy to be influenced. So help protect the stability of Bulan (the people and your administration) by way of extensive and honest communication.
    We are already looking forward to a brighter 2009 for our town!

    To Tonyboy LGU Bulan- PIO:

    There are two of them, 1) The P3million from this Fertilizer Fund scam received by Congressman Solis who allegedly gave it to our Mayor, and
    2) The involvement of Bulan Municipality with this mining operation involving illegal extraction of black (magnetic) sand, locally known as “margaja”.
    I have posted The Bulan-te Connection which dealt briefly with this Fertilizer scam drawing informations from various sources already mentioned in this post. Many have read this post (as visible in the site statistics to which I have the access being the site administrator) and two have commented. But as of now the public did not get any response clarifying the position of the mayor not really as an accused but just by way of doing her duty to inform on matters that “disturb” the town people.
    The same thing with this margaja case. Many are being disturbed for it seems that Bulan is in this business and that there is an investigation going on which would involve some other politicians in Bicol.
    We know that there are only few principled politicians in Bicol or in the whole Philippines in the like of Francis Escudero of Sorsogon . De Venecia who made a “name” lately by spearheading the moral revolution is actually also in Bolante’s list of politicians who received some millions of pesos in 2004. The same with Congressman Solis. He now heads this margaja probe who before that also told the press that he passed that P3million to the mayor of Bulan. From his side, this is not a case of two in one shot, but two shots in one,- in one bird. Well, Solis also got two shots in the past: first in 2004 as proponent of this fertilizer fund scam, second sometime between 2004-2005 as one among those jueting beneficiaries, the gambling scandal that went around the globe involving the Arroyos. A Bulan version of De Venecia?
    So I hope you could give the necessary clarifying comments regarding these two matters mentioned at the beginning should it be in your power.

    Hereunder is a copy of the Position Paper of the Municipal Government of Bulan on the issues you raised regarding Margaja mining in Bulan.

    POSITION PAPER OF THE MUNICIPAL GOVERNMENT OF BULAN, SORSOGON ON HOUSE RESOLUTION NO. 177, “ RESOLUTION DIRECTING THE COMMITTEE ON NATURAL RESOURCES TO CONDUCT AN INVESTIGATION, IN AID OF LEGISLATION, INTO THE ILLEGAL EXTRACTION/QUARRYING/MINING OF MAGNETIC SAND IN THE PROVINCE OF SORSOGON PARTICULARLY IN THE MUNICIPALITIES OF SANTA MAGDALENA AND BULAN, SORSOGON”.

    Section 138, Chapter 2, Book II of RA 7160 or the Local Government Code of 1991 states, “ xxx . The permit to extract sand, gravel and other quarry resources shall be issued exclusively by the provincial governor, pursuant to the ordinance of the sangguniang panlalawigan…”

    We respectfully submit to the Honorable Committee that the issue on the granting of approval and permits to prospectors of and operators on quarry resources is beyond the jurisdiction of the municipal government.

    What the municipal government does, upon application by the quarry operation applicant, as part of the application procedure, is to issue a certificate of endorsement that it interposes no objection prior to the securing of the necessary permits and license from the concerned DENR agencies and the provincial government.

    It is up to the concerned DENR agencies and the provincial government to judiciously decide whether the necessary requirements have been complied with. Given their technical expertise, which is beyond the scope of this local government, the former can very well determine and decide on the granting of permits on these resources.

    As far as the Municipal Government is concerned, we were informed that there was a permittee of magnetite sand quarrying in our locality, first in late 2006, and then the permit was renewed in August of 2008.

    On the matter of taxation, it will be up to the provincial government to remit the share to our municipal government and to the concerned barangays where the quarrying is taking place, for the utilization of our local resource.

    As to the matter of operation, while it is within our territorial jurisdiction, we are of the presumption that the supervision on compliance to standards set forth by law rests with the agencies concerned who have issued the permit to such an activity.
